Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, apps, and services offered by ThePlaceLabs (“we,” “our”), including but not limited to theplacelabs.com, bank.theplacelabs.com, golf.theplacelabs.com, trove.theplacelabs.com, insure.theplacelabs.com, forge.theplacelabs.com, and control.theplacelabs.com(collectively, the “Services”).

By creating an account or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least 13 years old to use the Services. You are responsible for the accuracy of the information you provide and for safeguarding your credentials. You may not share your account or transfer it to anyone else.

2. Acceptable use

You agree not to:

  • Use the Services to violate any law or the rights of any third party.
  • Attempt to gain unauthorized access to our systems, scrape or copy data at scale beyond what is reasonable for personal use, or probe for vulnerabilities outside of an established responsible-disclosure process.
  • Interfere with or disrupt the Services, including by uploading malicious code, generating excessive load, or attempting to evade rate limits.
  • Use the Services to harass, defame, or harm other users.

3. Your content

You retain ownership of the content you create or upload to the Services (for example, course ratings in Eagle Rank, collection items in Trove). You grant us a limited license to host, process, and display that content as needed to operate the Services for you.

4. No warranty

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA WILL BE ACCURATE OR PRESERVED.

5. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEPLACELABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, REGARDLESS OF THE LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

6. Suspension and termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, if we are required to do so by law, or if continued provision of the Services to you would create a risk to the Services or other users.

7. Account deletion

You may request deletion of your account and associated data at any time by emailing [email protected] or using the contact form.

8. Governing law and venue

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts.

9. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date at the top. Material changes will be communicated through the Services. Your continued use of the Services after a change indicates your acceptance of the revised Terms.
